H&C

Humanitarian and compassionate (H&C) consideration, under A25 and A25.1 of the IRPA, provides the flexibility to grant permanent residence status or a permanent resident visa to certain foreign nationals who would otherwise not qualify through any program, in cases in which there are compelling H&C grounds. We at Mann Immigration Services can assist you in preparing your submission based on any facts affecting your personal circumstances that you believe are relevant to request an H&C consideration.




Some factors which we can help you explain in your application as compelling H&C grounds include:

  • establishment in Canada
  • an inability to leave Canada that has led to establishment
  • ties to Canada
  • best interests of any children affected by your application
  • health considerations
  • family violence considerations
  • consequences of your separation from relative
  • factors in your country of origin (not related to seeking protection)
  • any other relevant factors you wish to have considered that are not related to seeking protection.

Who may benefit from this application:


You may apply for H&C consideration if you: 

  • Are a citizen or permanent resident of any country other than Canada
  • Have not already submitted an H&C application for which a decision has not been made
  • Do not have an outstanding refugee claim
  • Have not became a designated foreign national within the last 5 years
